Terms of Service

These Terms of Service ("Terms") govern your use of MightyPhoto (the "Service"), operated under the MightyPhoto brand ("MightyPhoto," "we," "us," or "our"). By accessing or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

Age requirement. By accessing or using the Service, you represent and warrant that: (a) you are at least 18 years of age or over the age of majority in the jurisdiction where you are a resident or citizen; and (b) your registration and use of the Service comply with all applicable laws and regulations. The Service is not directed to or intended for use by anyone under 18; if you are under 18, you may not access or use the Service. We reserve the right to suspend or terminate any account we believe is held by a minor.

1. Eligibility and your account

You must be at least 18 years old and legally able to enter into these Terms to use MightyPhoto. The Service is not directed to minors. You are responsible for providing accurate account information, keeping your credentials confidential, and all activity that occurs under your account.

If you use the Service on behalf of a company or other organization, you represent that you have authority to bind that organization to these Terms.

You may use the Service only where it is lawful for you to do so and where our third-party providers support the Service.

2. The Service

MightyPhoto lets you upload photos, submit text prompts, and receive AI-generated edited images. The Service depends on third-party providers for hosting, storage, payments, email, sign-in, analytics, and AI processing. We may add, remove, or change features, providers, models, limits, or availability at any time, and we do not guarantee that the Service will always be available, uninterrupted, or error-free.

3. Your content and outputs

You retain ownership of the photos, prompts, and other material you submit ("Your Content"). You grant MightyPhoto a limited license to host, copy, store, transmit, display, and process Your Content solely as needed to operate, secure, and support the Service for you, including sending Your Content to service providers, generating edits, storing them in your account, and returning them to you.

You represent and warrant that you have all rights needed to upload Your Content and request the edits you request, and that doing so does not violate any law, contract, privacy right, publicity right, copyright, trademark, or other third-party right. If Your Content includes other identifiable people, you are responsible for having the rights, notices, and consents needed to process and edit their images through the Service.

As between you and MightyPhoto, and to the extent permitted by applicable law and third-party terms, you own the edited images generated for your account. We do not represent that outputs are unique, copyrightable, non-infringing, cleared for any particular commercial use, or free from third-party rights.

4. Prohibited use

You may not use MightyPhoto to:

  • Create or edit content depicting minors in a sexual or exploitative context.
  • Create non-consensual intimate imagery of identifiable people.
  • Create content that defames, harasses, doxes, threatens, exploits, or impersonates a specific identifiable person.
  • Mislead people into believing an edited image is authentic, official, endorsed, or unedited when that would be deceptive, harmful, or unlawful.
  • Use the Service for biometric identification, surveillance, profiling, or decisions that could materially affect a person's rights, safety, employment, credit, housing, insurance, education, or access to essential services.
  • Upload or generate content that infringes intellectual property or privacy rights.
  • Create or distribute malware, scams, fraud, election deception, hate, harassment, explicit sexual content involving minors, or content that promotes violence or self-harm.
  • Violate any applicable law, third-party right, provider policy, or export or sanctions restriction.
  • Attempt to extract, reverse-engineer, or copy the Service or its underlying models.
  • Interfere with, abuse, overload, scrape, or bypass the security, rate limits, content filters, or access controls of the Service.

We may remove content, refuse service, or suspend or terminate accounts that we reasonably believe violate these Terms or create legal, safety, or operational risk.

5. Credits, payments, refunds, and chargebacks

Credits are purchased in packs. One successfully completed edit consumes one credit. Credits do not expire under our current pricing, have no cash value except where required by law, and are not transferable between accounts.

We may change pricing or credit-pack offerings at any time for future purchases, but the price you paid for previously completed purchases will not change.

Refunds. You may request a refund of unused credits within 14 days of the purchase that funded them. Refunds are limited to credits that are unused at the time we process the request, are issued to the original payment method, and are at our discretion outside that window or for partially used purchases. To request a refund, email support@mightyphoto.ai from the email on your account. If a specific edit fails through no fault of yours, we may re-credit or refund that edit even outside the 14-day window.

Chargebacks. If a payment is reversed, charged back, or otherwise reclaimed by you or your payment provider, we may remove the associated credits (including bringing your balance negative), suspend your account, and decline future purchases until the issue is resolved. Please contact support first so we can try to fix billing issues quickly. Nothing in these Terms limits any non-waivable payment dispute, refund, chargeback, or consumer protection rights you may have under applicable law.

6. AI outputs

MightyPhoto uses third-party AI models to produce edits. AI outputs may be inaccurate, inconsistent, offensive, incomplete, similar to outputs generated for others, or otherwise unsuitable for your needs. AI processing may also fail, be delayed, or be blocked by safety filters. You are responsible for reviewing outputs before using, sharing, publishing, or relying on them, including for any commercial, client, or public-facing purpose.

The Service is not designed for professional advice, identity verification, medical, legal, financial, insurance, employment, housing, education, public sector, safety-critical, or other high-risk uses. Do not rely on outputs for those purposes.

7. MightyPhoto intellectual property

The Service, including our software, site design, branding, and other content provided by us, is owned by MightyPhoto or our licensors and is protected by applicable intellectual property laws. These Terms do not give you ownership of the Service itself.

8. Suspension and termination

You may stop using the Service at any time. We may suspend or terminate your access, remove content, or disable accounts if we believe you violated these Terms, created legal or security risk, failed to pay amounts due, or used the Service in a way that could harm MightyPhoto, our providers, or other users.

After termination, some information may remain in backups, logs, payment records, or other records that we are legally or operationally required to keep, as described in our Privacy Policy.

9. Disclaimers and liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, TITLE, OR THAT THE SERVICE WILL BE SECURE, AVAILABLE, OR ERROR-FREE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MIGHTYPHOTO WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, GOODWILL, DATA, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO THE SERVICE OR THESE TERMS.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MIGHTYPHOTO'S TOTAL LIABILITY ARISING OUT OF OR RELATED TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR (B) USD $100.

10. Indemnity

To the maximum extent permitted by law, you will indemnify and hold harmless MightyPhoto from claims, losses, liabilities, and expenses, including reasonable legal fees, arising out of or related to Your Content, your use of the Service, or your violation of these Terms or applicable law.

11. Governing law and dispute resolution

These Terms and any dispute arising out of or related to them or the Service are governed by the laws of the Province of Saskatchewan and the federal laws of Canada applicable therein, without regard to conflict-of-law principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply. Nothing in these Terms limits non-waivable consumer protection rights or mandatory laws that apply where you live.

Informal resolution. Before starting any formal proceeding, you agree to first contact us at legal@mightyphoto.ai with a written description of the dispute and the relief you are seeking, and to attempt in good faith to resolve the dispute with us for at least 30 days before filing a claim.

Jurisdiction. If the dispute is not resolved informally, you and MightyPhoto agree that any legal action or proceeding arising out of or related to these Terms or the Service will be brought exclusively in the courts of the Province of Saskatchewan, Canada, and you consent to the personal jurisdiction of those courts.

Individual claims only. Any dispute resolution proceeding will be conducted on an individual basis and not as part of a class, consolidated, or representative action. To the maximum extent permitted by applicable law, you and MightyPhoto each waive any right to participate in a class, collective, or representative proceeding against the other.

Limitation period. To the extent permitted by applicable law, any claim arising out of or related to the Service or these Terms must be filed within one year after the claim arose; otherwise the claim is permanently barred.

12. Copyright complaints (Canada notice-and-notice)

We respect intellectual property rights. If you believe content available through the Service infringes your copyright, send a written notice to copyright@mightyphoto.ai that includes:

  • your full name, mailing address, and a telephone number or email at which we can reach you;
  • identification of the copyrighted work you claim has been infringed;
  • identification of the material you claim is infringing and information reasonably sufficient to let us locate it (e.g., the URL or account identifier);
  • the date and time of the alleged infringement, if known;
  • a statement, made under penalty of perjury (or its Canadian equivalent), that the information in the notice is accurate and that you are the rights holder or are authorized to act on the rights holder's behalf; and
  • your physical or electronic signature.

In accordance with sections 41.25 to 41.27 of the Canadian Copyright Act, we will forward complete notices that meet the statutory requirements to the user whose account is associated with the identified material. Notices that do not meet the requirements of the Act, that contain false or misleading information, or that include offers of settlement, payment demands, or generation of legal proceedings may be rejected. We may, in our discretion, remove content or suspend accounts when we believe doing so is appropriate, but we are not obligated to do so by Canadian law.

Repeat infringers may have their accounts terminated. Submitting a knowingly false notice may expose you to liability under applicable law.

13. General

Entire agreement. These Terms, together with our Privacy Policy, are the entire agreement between you and MightyPhoto regarding the Service and supersede any prior agreements on that subject.

Severability. If any provision of these Terms is held to be unenforceable, that provision will be enforced to the maximum extent permissible and the remaining provisions will remain in full force and effect.

No waiver. Our failure to enforce any provision of these Terms is not a waiver of our right to do so later.

Assignment. You may not assign or transfer these Terms or your account without our prior written consent. We may assign these Terms to an affiliate or to a successor in connection with a merger, acquisition, reorganization, or sale of assets.

Force majeure. We are not liable for any failure or delay in performance caused by events beyond our reasonable control, including outages of our infrastructure providers, network failures, acts of government, strikes, or natural events.

Survival. Sections 3 (Your content and outputs), 5 (Credits, payments, refunds, and chargebacks), 7 (MightyPhoto intellectual property), 9 (Disclaimers and liability), 10 (Indemnity), 11 (Governing law and dispute resolution), 12 (Copyright complaints), and this Section 13 survive termination of these Terms.

14. Changes to these Terms

We may update these Terms from time to time. Material changes will be posted on this page with an updated "Last updated" date. Your continued use of the Service after updated Terms take effect means you accept the revised Terms.
